Please read these Terms of Service (“Agreement”) carefully as they contain important information regarding your legal rights, remedies, and obligations. Services

brokenbow.com (“Website”) is an online platform that allows property owners (“Hosts”) to list their properties (“Properties”) for rental to potential guests (“Guests”). The Website is owned and operated by brokenbow.com LLC (“Company”), based in Broken Bow, Oklahoma. The Website allows Hosts to communicate with Guests and facilitate rental agreements.

Acceptance of Terms

These Terms of Service (“Agreement”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and brokenbow.com LLC (“brokenbow.com,” “we,” “us” or “our”), concerning your access to and use of the brokenbow.com website (“Site”) as well as any other media form, media channel, mobile website or mobile application related, linked or otherwise connected thereto (collectively, the “Services”).

You agree that by accessing the Site or using any of the Services, you have read, understood and agree to be bound by all of the terms and conditions contained in this Agreement, including our Privacy Policy, which is incorporated by reference into this Agreement, and any other policies, guidelines or rules that may be applicable to particular offerings on the Site.

IF YOU DO NOT AGREE WITH ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT, INCLUDING OUR PRIVACY POLICY, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Age Limitation

The Services are intended for users who are at least 25 years old. If you are under the age of 25, you are not permitted to register as a user or otherwise submit any personal information to us.

Hosts

Hosts are responsible for listing accurate and complete information about their properties, including availability, pricing, and cancellation policies. Hosts are solely responsible for any and all claims, damages, or liabilities arising from their Properties. Hosts must also comply with all applicable laws and regulations.

Guests

Guests are responsible for understanding and complying with all rules and regulations applicable to the properties they rent. Guests are solely responsible for any and all claims, damages, or liabilities arising from their use of a Property. Guests must also comply with all applicable laws and regulations.

Payment

When booking a reservation for a Listing through the Site, you will be required to provide us with certain information, including your credit card number and expiration date. You represent and warrant that you have the legal right to use any credit card(s) or other payment method(s) used to initiate any transaction. You will be charged a total price that includes the reservation fee, cleaning fee, and any additional taxes, fees, and surcharges. By submitting your payment information, you authorize us to facilitate the reservation and agree to pay the total amount shown, which includes all applicable fees. Once reservation is confirmed, payment is due in two parts. You will be charged a deposit of 10% of the total reservation fee upon booking. The remainder of the fee is determined by the host/manager. After the rental agreement is signed, further payment arrangement will be directed by the host/manager. Within 30 days of check-in, most hosts/managers require full payment.

Cancellation

Hosts may set their own cancellation policies for their Properties. Guests should carefully review the cancellation policy for the specific Property they are interested in renting. In the event of a cancellation, Host will refund the applicable fees according to the cancellation policy.

Intellectual Property

The Website and all content, including text, graphics, logos, and images, are the exclusive property of brokenbow.com or its licensors. You may not copy, modify, distribute, display, transmit, or create derivative works from any part of the Website without the express written permission of brokenbow.com.

Limitation of Liability

To the fullest extent permitted by law, brokenbow.com and its directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of or inability to use the Website or any Property, whether or not such damages were foreseeable or whether BrokenBow.com was advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold brokenbow.com and its affiliates, officers, directors, employees, and agents harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of this Agreement or your violation of any law or the rights of a third party.

Disclaimer

The information contained on the Site and in the Terms and Conditions is for general information purposes only. brokenbow.com assumes no responsibility for errors or omissions in the contents on the Site and the Services.

Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the Oklahoma, without giving effect to any principles of conflicts of law. Any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination, shall be finally resolved by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.
