The Website is owned and operated by BrokenBow.com LLC (“Company”), based in Broken Bow, Oklahoma. The Website allows Hosts to communicate with Guests and facilitate rental agreements.

Acceptance of Terms: These Terms of Service (“Agreement”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and BrokenBow.com LLC (“brokenbow.com,” “we,” “us” or “our”), concerning your access to and use of the brokenbow.com website (“Site”) as well as any other media form, media channel, mobile Website or mobile application related, linked or otherwise connected thereto (collectively, the “Services”). You agree that by accessing the Site or using any of the Services, you have read, understood, and agree to be bound by all of the terms and conditions contained in this Agreement, including our Privacy Policy, which is incorporated by reference into this Agreement, and any other policies, guidelines or rules that may apply to particular offerings on the Site.

SUPPOSE YOU DO NOT AGREE WITH ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT, INCLUDING OUR PRIVACY POLICY. IN THAT CASE, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE, AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Age Limitation: The Services are intended for users at least 18. If you are under 18, you are not permitted to register as a user or otherwise submit any personal information to us.

Hosts: Hosts are responsible for listing accurate and complete information about their Properties, including availability, pricing, and cancellation policies. Hosts are solely responsible for any claims, damages, or liabilities arising from their Properties. Hosts must also comply with all applicable laws and regulations.

Guests: Guests are responsible for understanding and complying with all rules and regulations applicable to the Properties they rent. Guests are solely responsible for any claims, damages, or liabilities arising from using a Property. Guests must also comply with all applicable laws and regulations.

Payment: When booking a reservation for a Listing through the Site, you must provide us with certain information, including your credit card number and expiration date. You represent and warrant that you have the legal right to use any credit card(s) or other payment method(s) used to initiate any transaction. You will be charged a total price that includes the reservation fee, cleaning fee, and any additional taxes, fees, and surcharges. By submitting your payment information, you authorize us to facilitate the reservation and agree to pay the total amount shown, which includes all applicable fees.

Once the reservation is confirmed, payment is due in two parts. Upon booking, you will be charged a deposit of 10% of the total reservation fee. The host/manager determines the remainder of the fee. After the rental Agreement is signed, the host/manager will direct further payment arrangements. Most hosts/managers require full payment within 30 days of check-in.

Cancellation: Hosts may set their cancellation policies for their Properties. Guests should carefully review the cancellation policy for the Property they are interested in renting. The host will refund the applicable fees according to the cancellation policy in the event of a cancellation.

SMS Terms of Service: By opting into SMS from a web form or other medium, you agree to receive SMS messages from brokenbow.com. This includes SMS messages for booking confirmations, reservation reminders, updates about your stay, and promotional offers. Message frequency varies. Message and data rates may apply. Limitation of Liability: To the fullest extent permitted by law, brokenbow.com, and its directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of or inability to use the Website or any Property, whether or not such damages were foreseeable or whether brokenbow.com was advised of the possibility of such damages.

Indemnification: You agree to indemnify and hold brokenbow.com and its affiliates, officers, directors, employees, and agents harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of this Agreement or your violation of any law or the rights of a third party.

Dispute Resolution: This Agreement shall be governed by and construed by the laws of Oklahoma without giving effect to any principles of conflicts of law. Any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity, or termination, shall be finally resolved by arbitration by the Commercial Arbitration Rules of the American Arbitration Association.
